In a tweet on its social media account yesterday, the International Criminal Court (ICC) reiterated that it needs state cooperation to arrest and transfer Saif Al-Islam Qaddafi to its courts.
Saif is standing as a candidate in Libya’s presidential elections planned for 24 December 2021. Initially, Libya’s High National Elections Commission (HNEC) disqualified him, however, upon his appeal the courts reinstated him.
The ICC tweeted ‘‘Saif Gaddafi remains at large. He is suspected of crimes against humanity committed in Libya. The ICC relies on State cooperation worldwide to arrest and transfer him to Court’’.
The tweet came as part of a general information campaign regarding those wanted by the ICC. The ICC said ‘‘To date, 12 persons for whom the ICC has issued arrest warrants remain at large. All suspects of grave international crimes should be brought to justice, as we strive together to build a more just world.’’
However, Saif is not the only Libyan wanted by the ICC. Under the heading on its website ‘‘Trying individuals for genocide, war crimes, crimes against humanity, and aggression’’, two other Libyans are listed with Saif and another nine other non-Libyans.

Gaddafi, Saif Al-Islam
Honorary chairman of the Gaddafi International Charity and Development Foundation and acting as the Libyan de facto Prime Minister, at time of warrant. Arrest warrant: 27 June 2011
Charges: two counts of crimes against humanity: murder and persecution, allegedly committed in 2011 in Libya. Case also involved charges Muammar Gaddafi and Abdullah Al-Senussi in warrant issued on 27 June 2011. Case against Abdullah Al-Senussi was declared inadmissible on 11 October 2013. Case against Muammar Gaddafi was terminated on 22 November 2011, following his death.
Al-Werfalli, Mahmoud Mustafa Busayf
Nationality: Libyan Date of birth: 1978 Function: Commander in the Al-Saiqa Brigade
Charges: Mr Al-Werfalli is alleged to have directly committed and to have ordered the commission of murder as a war crime in the context of seven incidents, involving 33 persons, which took place from on or before 3 June 2016 until on or about 17 July 2017 in Benghazi or surrounding areas, in Libya as well as Murder as a war crime in the context of an eighth incident which took place on 24 January 2018, when Mr. Al-Werfalli allegedly shot dead 10 persons in front of the Bi’at al-Radwan Mosque in Benghazi, Libya.
Khaled, Al-Tuhamy Mohamed
Libyan national, born in 1942 in the Janzour area of Libya, west of Tripoli. Alleged former Lieutenant General of the Libyan army and former head of the Libyan Internal Security Agency (ISA).
Charges: 4 crimes against humanity: imprisonment, torture, persecution, and other inhumane acts allegedly committed in Libya from 15 February 2011 until 24 August 2011; and 3 war crimes: torture, cruel treatment and outrages upon personal dignity allegedly committed in Libya from at least early March 2011 to 24 August 2011.
