Libya’s Administrative Control Authority (ACA) has today cautioned the Serraj-GNA Foreign Ministry for extending diplomatic postings abroad beyond the legally permitted four-year period. The ACA is the state oversight body for state employees.
The ACA stated in a press release today that it noted although a number of diplomats posted abroad had come to the end of their term, the Foreign Ministry had not issued decrees ordering their return home. This is a clear contravention of article 2 of the Labour Law of 2001. This law clearly prescribes that the maximum term diplomats can spend abroad is four years and that they cannot be reposted abroad until they had spent the same time in Libya that they had spent abroad.
The ACA, therefore, instructed the Foreign Ministry to issue decrees to order those concerned to return to their previous work in Libya. It also called on all Libyan embassies and missions abroad to refer their final certificates of salaries (payment slips) to the Foreign Ministry.
To this end, the ACA warned that it would, in coordination with the Finance Ministry, freeze the salaries of those contravening the law and overstaying their terms abroad.
it will be recalled that the Serraj-led GNA list of proposed diplomatic postings was recently leaked, which included a number of diplomats with extentions to their postings. The Presidency Council / Government of National Accord has not confirmed the list.
