Terms & Conditions

All General Terms & Conditions apply to all users of www.libyaherald.com and Libya Herald content; including paid subscribers and general visitors (non-paid subscribers)

These terms and conditions were updated on 16 February 2022. We may update these terms and conditions to reflect changes in our services or business practices, and we will provide notice of such changes in this section of the site. This Subscriber Agreement and Terms of Use govern your use of Libya Herald content. If you do not agree with any of the Libya Herald’s Terms and Conditions of Use, as provided on this site, you are asked not to use or subscribe to our services.

Terms & Conditions for Paid Subscribers

1.     Registration, acceptance and activation

The registration process is only available in English. When you register for the Subscription, subscribers must provide the Libya Herald with complete and accurate payment information in English. By submitting payment details subscribers promise that they are entitled to purchase a subscription using those payment details. The price of your Subscription will be as indicated on the website and will be for the period of time indicated.

Your international online credit card payment will then be processed through our payment gateway service administered by third parties with whom we have a contractual relationship, who will confirm to us if your payment is validated. You will be giving your consent that your credit card details may be accessed by the payment gateway service provider for the purposes of the validation of payment.

All subscriptions are subject to acceptance by us. The Libya Herald reserves the right to reject any request to subscribe – at its discretion, for any or no reason.

By placing an order for an online subscription through our site, you warrant that you are 18 years or over and legally able to enter into this subscription agreement. You also confirm that you are making application for your own use and that you will not do anything which would assist anyone who is not a registered user to gain access to subscription content on libyaherald.com

The Libya Herald does not guarantee that your subscription will be activated by any specified time. By submitting your payment and other subscription details, you are making an offer to us to buy a subscription.

Your subscription account

You agree to pay the subscription fees and any other charges incurred in connection with your user name and password for a Service at the rates displayed online when you subscribe. We will continue to notify you of your payments and the subscription will continue indefinitely until such time as you cancel the Subscription

If you access libyaherald.com subscription service using a password, you are solely responsible for maintaining the confidentiality of that password. Only one named individual may access as a subscriber using the same user name or password. If you provide someone else with access to your password, they will have the ability to view information about your account and make changes. Password sharing is a breach of our terms and conditions and is likely to result in an infringement of copyright.

You agree to notify us promptly if you change your address or email so we can continue to contact you and send any notices required hereunder. If you fail to notify us promptly of a change, then any notice we send to you, using the information we have, shall be deemed sufficient notice.

Permission to access libyaherald.com is granted at the sole discretion of the Libya Herald and such permission may be withdrawn at any time without notice. We reserve the right to add to or change the terms of this agreement. It is your responsibility to refer to and comply with these terms on accessing libyaherald.com. Failure to comply may lead to action being taken against you. The Libya Herald reserves the right to suspend or terminate your subscription if you breach the Libya Herald’s terms and conditions, with or without notice and without further obligation to you. You will not be entitled to any refund in these circumstances.

2.     Means of payment

To enable your subscription, you can pay online by credit card or offline by bank transfer, cheque or by paying cash in Tripoli. Contact Sami Zaptia by email on [email protected]

For credit card payments you should provide valid credit card details. The accepted payment method is through Mastercard and Visa credit cards. Additional charges may apply to credit card payments but we are not responsible for additional charges that your bank may apply. Subscription fees will be billed on automatic renewal.

If you default in one payment that has become due, we reserve the right to cancel your subscription immediately without notice and without prejudice to our right to recover from you any outstanding amount due by you to us.

Unless we state in writing otherwise, all fees and charges are nonrefundable.

3.     Changes to Subscriber Agreement.

We may change our terms at any time by notifying you of the change by posting a notice online that the terms have been “updated”. The changes also will appear on this site, under subscriber terms & conditions.

We may change the subscription rates by giving you notice in advance. To terminate you must do so before your next payment becomes due. Subscribers will be informed by email before the end of the subscription period that their subscription is being renewed. If you wish to continue, your subscription will automatically update at the next renewal date. The subscription will continue and renew automatically until the subscriber informs the Libya Herald in writing to [email protected] before their current subscription period ends, that s/he no longer wishes to receive the service, in which case s/he will cancel and stop paying the subscriber fees..

You may not transfer, assign or otherwise dispose of any of your rights or obligations arising under this Agreement, without our prior written consent. For the avoidance of doubt, you are not permitted to sell on or transfer the benefit of your subscriptions services to third parties.

We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under it, at any time during the term of the Agreement.

The Libya Herald will try to operate libyaherald.com with reasonable skill and care and will use reasonable efforts to promptly remedy any faults of which it is aware. This is the only promise the Libya Herald makes in relation to the provision of libyaherald.com.

If we are in breach of the above, we will only be liable for any damages that subscribers incur for a limit equal to the price paid by the subscriber for the period of the subscription.

libyaherald.com and its content are provided on an “as is” and “as available” basis. This means that the Libya Herald does not make any promises in respect of libyaherald.com other than the above.

You may cancel your subscription by entering your subscriber account or by writing to [email protected] and receiving email confirmation that your Libya Herald subscription is cancelled.  If you choose to cancel your subscription, you will continue enjoying the Subscription until the expiry date of that renewal.

4.     Events beyond our reasonable control.

We will do our best to provide constant, uninterrupted access to libyaherald.com, however we do not guarantee this, and do not accept no responsibility or liability for any interruption or delay. This disclaimer applies equally to subscribers’ use of libyaherald.com and its content. The Libya Herald is not liable for matters beyond its reasonable control.  The Libya Herald does not control third party communication (including subscriber’s internet service providers), the internet, acts of God, or the acts of third parties.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including reasons of Force Majeure which shall include any default due to an act of God, war or threatened war, act of terrorism or threatened act of terrorism, strike, lockout, industrial action, health epidemic or pandemic, fire, flood, drought, tempest or other event beyond the control of either party.

Our performance under this subscriber agreement is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period.

5.     Disclaimers of Warranties and Limitation on Liability

Although the Libya Herald tries to ensure the content it publishes is accurate, it makes no guarantee as to accuracy.  The Libya Herald disclaims all warranties, representations, conditions and duties (barring the duty of good faith) of any kind, including without limitation, any warranties of satisfactory quality merchantablity, or fitness for a particular purpose. The Libya Herald excludes any warranty, express or implied, as to the quality, accuracy, timeliness, performance, security, completeness or fitness for a particular purpose of libyaherald.com and the Libya Herald content.

You agree that your access to, and use of the Service and the content and tools available through the subscription or visitor (not paid subscriber) is on an as-is, as available basis and we specifically disclaim any representation or warranties, express or implied.

We accept no financial responsibility for your use of libyaherald.com and the Libya Herald Content, on the basis that you can view www.libyaherald.com and certain content and services free-of-charge, and the cost of a subscription for additional access rights is relatively inexpensive. Our liability for losses you suffer is strictly limited to the charges you have paid (if any) for the subscription services.

The Libya Herald content (including any information we publish regarding third party products) is only for your general information and entertainment purposes and is not intended to address your particular requirements.

In particular, the Libya Herald content, including any other content provided by third parties, does not constitute any form of advice, recommendation, representation, endorsement or arrangement by the Libya Herald. It is not intended to be and should not be relied upon by users in making (or refraining from making) any specific investment, purchase, sale or other decisions. Appropriate independent professional advice should be obtained before making any such decisions.

We will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading or listening to the material or any part of it. It is your decision whether you use or purchase any third party products or services made available on or via third party sites. The Libya Herald is not responsible for any error or inaccuracy in advertising .

Our site contains links to third party sites which are not subject to our privacy policy. We recommend that you read the privacy policy of any such sites that you visit.

7.     Governing Law and Jurisdiction.

If you are a user whose principal address or principal use of libyaherald.com occurs in any jurisdiction other than Libya (where Libyan law will apply), then these terms and conditions will be subject to UK law. The Libya Herald will also retain the right to bring or enforce proceedings in the courts of the country of your residence, the country of your principal place of business, or country from where you subscribed and accepted terms and conditions.
